These terms govern your use of spitericatering.net and provide basic conditions for enquiries and transactions with Spiteri Catering. A written quotation, order confirmation, service agreement or other contract may contain additional or different terms and will take priority for that transaction if there is a conflict.
1. About us and acceptance
This website is operated by Spiteri Catering from Horeca Building, Triq l-Imgarr, Xewkija, XWK 9012, Gozo, Malta.
By accessing or using the website, you agree to these terms. If you do not agree, please do not use the website. If you use the website on behalf of a company or other organisation, you confirm that you have authority to act for it.
2. Website information and permitted use
Website information
Website content is provided for general information. Product descriptions, images, dimensions, specifications, availability and indicative information may change and should be confirmed in a written quotation or order confirmation before you rely on them.
We take reasonable care with website content but do not promise that it is always complete, current or free from errors. The website does not provide engineering, legal, tax, health-and-safety or other professional advice.
Permitted use
You may use the website for lawful business or personal purposes connected with learning about, enquiring about or obtaining our products and services.
You must not:
- Use the website unlawfully, fraudulently or in a way that infringes another person's rights.
- Attempt to gain unauthorised access to the website, accounts, servers or data.
- Introduce malware, harmful code, automated abuse or an unreasonable load on the website.

4. Enquiries, quotations and orders

An enquiry is an invitation to discuss requirements and is not an order. Unless stated otherwise, a quotation is an invitation to place an order and may be subject to validity dates, stock, site assessment, technical confirmation and other conditions shown in the quotation.
Order acceptance
A binding order is formed only when we issue written acceptance or an order confirmation, or when another written agreement signed or accepted by both parties says that a contract has been formed.
We may decline or ask to amend an order where products are unavailable, information is incomplete, a pricing or specification error is identified, credit requirements are not met, or the requested work cannot reasonably or safely be performed.
Changes and cancellation
Requested changes or cancellations are subject to our written agreement and may involve reasonable costs already incurred, including customised goods, special orders, design work, transport or labour. Any mandatory statutory rights remain unaffected.
5. Prices, tax and payment
Prices, taxes, deposits, payment stages, currency and accepted payment methods will be stated in the relevant quotation, order confirmation or invoice. Unless expressly included, website content does not constitute a fixed price offer.
You must pay amounts when due. Where permitted by law and the applicable agreement, overdue sums may result in suspended supply or service and may incur reasonable recovery costs or interest specified in the transaction documents.
You are responsible for supplying correct billing details and any information reasonably needed for invoicing, tax treatment or credit checks.
6. Products, specifications and availability
Product appearance and colour may vary from screen images. Measurements and performance depend on the manufacturer's specifications, correct installation, utilities, environment, maintenance and intended use.
Manufacturers may change models or specifications. We will seek your approval before any material substitution unless the written agreement already permits an equivalent replacement.
Availability and lead times are estimates until confirmed. Delays outside our reasonable control may occur, including manufacturer, shipping, customs, utility, site-access or supply-chain delays.
7. Delivery, site access and risk
Delivery dates and locations will be agreed in writing. Unless agreed otherwise, you must provide safe and suitable access, authorised personnel to receive goods, and accurate information about stairs, lifts, doorways, loading restrictions and other site conditions.
You may be responsible for additional costs caused by failed access, inaccurate site information, storage, redelivery or waiting time, where those costs were not caused by us.
Risk, title, inspection requirements and acceptance of goods will be governed by the applicable quotation, order confirmation or mandatory law. You should report visible damage, shortage or incorrect items promptly and retain relevant packaging and evidence.
8. Design and installation services
Designs, layouts and equipment recommendations depend on the information, dimensions, utilities, workflows and requirements provided to us. You are responsible for reviewing and approving plans, specifications and assumptions before work or ordering proceeds.
Unless expressly included in writing, you remain responsible for building permissions, landlord approvals, structural suitability, ventilation, fire safety, drainage, electrical, gas, water and other utility works, and for compliance matters outside our agreed scope.
Installation areas must be safe, clear and ready on the agreed date. Work may be paused where conditions are unsafe or materially different from the information supplied.
9. Warranties, returns and technical support
Applicable product or workmanship warranties will be stated in the relevant transaction documents or manufacturer's warranty. Warranty coverage may require correct installation, intended use, routine cleaning and maintenance, and compliance with manufacturer instructions.
Warranty coverage generally does not extend to misuse, neglect, unauthorised modification or repair, accidental damage, consumable parts, unsuitable utilities or environmental conditions, normal wear and tear, or faults outside the warranty terms.
Returns require prior agreement and are subject to the applicable written terms, the condition and type of goods, manufacturer restrictions and mandatory law. Bespoke, used, installed or special-order goods may not be returnable unless faulty or otherwise required by law.
Technical-support response times are not guaranteed unless a separate service-level agreement applies. You must provide reasonable access and accurate equipment and fault information.
10. Intellectual property
The website and its text, branding, graphics, layouts, photographs and other content are owned by or licensed to Spiteri Catering and are protected by applicable intellectual-property laws.
You may view and print reasonable extracts for your own legitimate use. You may not reproduce, adapt, distribute, publish, sell or create derivative commercial materials from website content without prior written permission, except where law permits.
Any drawings, plans, specifications or proposals supplied for a project remain subject to the intellectual-property and permitted-use terms in the relevant quotation or agreement.
11. Third-party products, content and links
References to manufacturers, third-party products or external websites do not make us responsible for third-party content, availability, policies or performance. Third-party terms and warranty conditions may apply.
You use external links at your own discretion and should review the relevant third party's terms and privacy information.
12. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation and any mandatory rights or remedies.
To the extent permitted by law, we are not liable for losses arising solely from reliance on general website content where current specifications or professional advice should reasonably have been obtained.
For business users and transactions, any exclusions, caps and categories of recoverable loss will be those stated in the applicable quotation, order confirmation, service agreement or other written contract. If no separate written limitation applies, liability will be determined under applicable law.
You are responsible for taking reasonable steps to mitigate loss and for maintaining appropriate business continuity, data backup, insurance, safety and maintenance arrangements.
13. Events outside reasonable control
Neither party is responsible for delay or failure caused by events beyond its reasonable control, provided the affected party takes reasonable steps to reduce the impact and resumes performance when reasonably possible. Payment obligations for goods or services already supplied are unaffected.
14. Privacy
Our handling of personal data is explained in our Privacy Policy. Cookie choices can be managed through the website's cookie controls.
15. Changes, availability and termination
We may update the website and these terms from time to time. The date at the top indicates the latest revision. Changes apply from publication and do not retrospectively alter a contract already formed unless the parties agree or law requires it.
We may suspend, change or withdraw all or part of the website without guaranteeing continuous availability. Provisions intended to continue, including intellectual property, liability and governing law, survive termination of website access.
16. Governing law and disputes
These website terms are governed by the laws of Malta. The courts of Malta will have jurisdiction, subject to any mandatory rights you may have to bring a claim elsewhere.
Before starting formal proceedings, please contact us and give reasonable details of the issue so the parties can try to resolve it promptly.
17. General terms
- If a provision is found invalid or unenforceable, the remaining provisions continue in effect.
- A delay in enforcing a right is not a waiver of that right.
- You may not transfer your rights or obligations under a transaction without our written consent, except where mandatory law permits.
- Headings are for convenience and do not affect interpretation.
